Terms of Service

1. Acceptance of Terms

By accessing our website, submitting a booking request, or chartering a vessel operated by Seven Seas Yacht Charters (“Seven Seas,” “Company,” “we,” “us,” or “our”), you (“Guest” or “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not proceed with a booking.

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Seven Seas with respect to your use of our services.

2. Charter Bookings & Payment

Booking Process

All charter bookings are subject to availability and confirmation by Seven Seas. Submitting a booking request does not guarantee a reservation. A booking is only confirmed upon receipt of the required deposit payment and written confirmation from Seven Seas.

Deposit

A 25% non-refundable deposit (calculated on the base charter price, before gratuity and taxes) is required to secure your booking. The deposit link is valid for 24 hours from the time of booking confirmation. Failure to pay the deposit within this window will automatically release the reserved time slot.

Balance Payment

The remaining balance — including base charter price (minus deposit), gratuity, and applicable taxes — is due no later than 48 hours prior to the charter departure. Failure to pay the remaining balance by this deadline may result in cancellation of the booking without refund of the deposit.

Pricing

All prices listed on our website are in US Dollars (USD). Prices are subject to change without notice until a deposit has been received and a booking is confirmed. Florida state sales tax of 7% is applied to the base charter price.

Payment Processing

All payment transactions are processed securely through Stripe, Inc.Seven Seas does not store credit card or payment card information on its servers.

3. Gratuity

A minimum gratuity of 15% of the base charter price is added to all charters. This gratuity goes directly to the captain and crew. Guests may choose a higher gratuity percentage (up to 30%) during the booking process. Gratuity is charged on the base charter price only (before taxes).

4. Cancellation Policy

All cancellation requests must be submitted in writing via email to sales@sevenseas.yachts. The following cancellation terms apply based on the time of cancellation relative to the scheduled charter date:

Any amounts paid beyond the deposit are refundable in proportion to the cancellation tier above, minus the non-refundable deposit portion.

5. No-Show Policy

A no-show occurs when the primary booking contact and guest party fail to appear at the departure location within 30 minutes of the scheduled departure time without prior notification. In the event of a no-show, the full charter amount is forfeited and no refund will be issued.

6. Weather & Force Majeure

The safety of our guests and crew is our highest priority. The captain retains sole and final authority to determine whether weather or sea conditions are safe for departure or continued operation. This determination is made at the captain’s professional discretion.

In the event of a cancellation or curtailment due to unsafe weather conditions, Seven Seas will offer to reschedule the charter to a mutually agreeable date within 12 months of the original charter date. Weather-related cancellations are not eligible for monetary refunds.

Force majeure events — including but not limited to natural disasters, government orders, port closures, acts of terrorism, or other circumstances beyond our reasonable control — may result in rescheduling or cancellation at Seven Seas’ discretion, without liability to Seven Seas beyond the value of the charter.

7. Guest Conduct

All guests are expected to conduct themselves in a safe, lawful, and respectful manner throughout the charter. The captain has the right — in their sole discretion — to:

  • Refuse boarding to any guest prior to departure
  • Terminate a charter and return to port at any time if a guest’s conduct poses a safety risk, violates the law, or is deemed disruptive by the captain

In the event of an early termination due to guest misconduct, no refund will be issued for any unused charter time.

Guests are responsible for any damage to the vessel, equipment, or property caused by their negligence or intentional misconduct.

8. Alcohol Policy

Guests must be 21 years of age or older to consume alcohol on board. It is the responsibility of the primary booking contact to ensure that all members of their party comply with this requirement. Seven Seas and its crew reserve the right to request valid identification from any guest and to refuse service to anyone who appears to be underage or excessively intoxicated.

9. Maximum Guest Capacity

The maximum guest capacity for all Seven Seas charters is 12 persons, as determined by the vessel’s U.S. Coast Guard Certificate of Inspection. No exceptions will be made. Guests who exceed this limit at the time of boarding will be asked to reduce their party to comply with this limit before departure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Seven Seas Yacht Charters, its owners, officers, employees, agents, and crew shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of enjoyment, loss of income, or personal injury, arising out of or in connection with your charter booking or use of the vessel.

Seven Seas’ total liability to any guest or booking party shall not exceed the total amount paid by that party for the specific charter giving rise to the claim.

Guests participate in all water activities (including use of Sea-Doos, swim platform, inflatable trampoline, and floating platform) at their own risk. Seven Seas provides safety briefings and equipment but assumes no liability for injury arising from voluntary participation in these activities.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

12. Modifications to These Terms

Seven Seas reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after any modifications constitutes your acceptance of the revised Terms.
